Update on Renters

Well...my letter worked. I got a call last night from the male renter. He had received my letter. He wasn't aware that the rent wasn't being paid. He had given his wife the money to pay it. She wasn't paying it. She has since left him and their child to go on a drug and alcohol binge. he has agreed to make weekly payments to get it caught up. He is desperate to not lose his place to live. His mother is moving in with him to help him out. Hopefully He will be able to make the payments and then all will be golden. We will see though.

    It will only works if you get paid. Talk and discussion is a beginning, but cash is king in this situation.

    Only accept cash as payment, and have blank receipts made out (you can fill in what is paid and what is owed) and ready to give in exchange. Have him initial the receipt and have a total reflect any late charges. This will help you in the event that you do need to evict. Don't accept checks, they can bounce. Also look into having a 5-day notice ready (in my state it is the first step and is legal notification of your intent to move to evict if they do not pay fully in 5 days).

    I've heard not to ever let an adult who is not on the lease move into a rental--they've got to be added to the contract. If the person who is on the lease leaves, and the other remains, you might still have to go through the eviction process on a person who does not even have legal obligation to pay a cent of rent. I'm sure it isn't the same everywhere, though.

    NGAgal, is there a local landlords association you can join? My neighborhood has one and you can learn all the ins & outs of landlording, and get personal experience, tips, guidance from those who've been there, done that.

    Well, assuming that it is the truth, it does lead to some explanation for the past several months. I hope that you are able to get some legal support behind you for this, and even more, I hope that the tenant is reliable in making the back payments. You deserve some insurance that you are being paid rent, for crying out loud! Good luck...
